Terms and Conditions

1. The entrant agrees and acknowledges that they have read these Conditions of Entry and the Schedule, and that entry into the Promotion constitutes acceptance of them. Capitalised terms have the meaning given in the Schedule unless stated otherwise.
2. The Promotion commences and closes on the dates and at the times stated in the Promotional Period in the Schedule. Entrants whose valid and eligible entries are received by the Promoter during the Promotional Period and by the relevant Entry Deadline can claim a Free Cheeseburger. Entries are deemed received when recorded by the Promoter or its platform provider, not when transmitted or deposited by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
3. To be eligible to enter, an entrant must be 18 years of age or older and satisfy the eligibility requirements in the Schedule at the time of entry. Entries from persons under the age of 18 will be deemed invalid and ineligible to claim a Free Cheeseburger. The Promoter may require reasonable evidence of age, identity and Australian residency before issuing a Voucher.
4. Employees, officers and contractors of the Promoter, any agency or supplier directly associated with conducting the Promotion, any organisation benefiting from the Promotion, the Promoter’s distributors, suppliers, subsidiaries, associated companies and agencies, and the immediate family members of any such person, are not eligible to enter. Immediate family member means a spouse, ex-spouse, de facto partner, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
5. Entry is free. No purchase is required. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider. Any cost of accessing the Internet or mobile data is the entrant’s responsibility and is charged by the entrant’s service provider.
6. Only one (1) entry per person is permitted per Eligible Round. Automated, bulk, duplicate or third-party entries and entries made using multiple email addresses or identities, may be disqualified.
7. The value of the Free Cheeseburger is based on its recommended retail price at the date these Conditions of Entry are published. The Promoter accepts no responsibility for any subsequent variation in the value of the Free Cheeseburger after that date.
8. The Free Cheeseburger and Voucher cannot be exchanged, transferred or redeemed for cash or any other item unless the Promoter agrees otherwise in writing or applicable law requires otherwise.
9. If the Free Cheeseburger becomes unavailable for reasons beyond the Promoter’s reasonable control, it may be substituted with an item of equal or greater value.
10. Entrants' personal information will be collected by the Promoter through the entry form. Personal information will be stored on the Promoter's database. Where an entrant separately opts in to WBCo marketing, the Promoter may use their contact details to send WNBL news, offers and event information electronically. Marketing consent is optional and is not a condition of entry. The Promoter will handle personal information in accordance with its privacy policy which is located at www.wnbl.com.au/privacy-policy. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and agents and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. Hungry Jack’s will separately collect personal information directly from entrants who register for or log in to the Hungry Jack’s App and will handle that information in accordance with its own privacy policy. The Promoter is not responsible for Hungry Jack’s collection, use or disclosure of that information. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a Free Cheeseburger in the Promotion.
11. A Voucher will only be issued to the person named in the entry. Any entry made on behalf of an entrant or by a third party will be invalid. The Promoter may require proof of identity and eligibility before issuing a Voucher.
12. The Free Cheeseburger and Voucher are supplied by Hungry Jack’s and are subject to Hungry Jack’s terms and conditions, including the terms of use of the Hungry Jack’s App. The Promoter does not own, operate or control the Hungry Jack’s App or any Hungry Jack’s restaurant. To the extent permitted by law, the Promoter is not liable for any delay or failure by Hungry Jack’s to honour a Voucher, or for the availability, operation or security of the Hungry Jack’s App, except to the extent that the Promoter fails to comply with its obligations under these Conditions of Entry or applicable law.
13. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrants’ details (including an entrant’s identity, age and place of residence). In the event that an entrant cannot provide suitable proof as required by the Promoter to validate their entry, the entrant will forfeit the Free Cheeseburger in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect, duplicate, fraudulent or otherwise non-compliant entries may, at the Promoter’s discretion, be deemed invalid. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are invalid. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid. The Promoter may also disqualify an entrant who tampers with or attempts to interfere with the entry process, the Promotion or the entry form, or otherwise breaches these Conditions of Entry.
14. The Promoter may disqualify entries in the event of non-compliance with these Conditions of Entry. Any dispute concerning the conduct of the Promotion or the issue of a Voucher or the Free Cheeseburger should first be raised with the Promoter for good faith resolution in direct consultation with the entrant. If the dispute cannot be resolved, the Promoter’s decision will be final. Nothing in this clause limits any statutory right or complaint mechanism available to an entrant.
15. The Promotion will be promoted during the Promotional Period through venue screens at WNBL games, the Promoter’s website (www.wnbl.com.au) and app, electronic direct marketing to the Promoter's subscribers who have opted in to receive it, paid social media advertising, broadcast, and the Promoter’s social media accounts on Facebook (https://www.facebook.com/TheWNBL/), Instagram (https://www.instagram.com/wnbl/) and X (https://x.com/WNBL). The Promotion will also be promoted by Hungry Jack’s on its website (.https://www.hungryjacks.com.au/community), electronic direct marketing and Hungry Jacks social media accounts on Facebook ([https://www.facebook.com/HungryJacks/]), Instagram (https://www.instagram.com/hungryjacksau/) and X ([https://x.com/HungryJacksAU]). The Promotion is in no way sponsored, endorsed, administered by or associated with any social media platform, and entrants release each social media platform from all liability arising in respect of the Promotion. Any questions about the Promotion must be directed to the Promoter. Entry can only be made via the landing page specified in the Schedule (How to Enter).
16. Entry and continued participation in the Promotion is dependent on the entrant following and acting in accordance with the applicable terms of use of any social media platform used to access or participate in the Promotion, including the terms of use for Facebook (https://www.facebook.com/legal/terms), Instagram (https://help.instagram.com/581066165581870/) and X (https://x.com/en/tos). The entrant releases Meta Platforms, Inc. (Facebook and Instagram) and X Corp (and their respective associated companies) from all liabilities arising in respect of the Promotion.
17. If any aspect of the Promotion cannot run as planned, including by reason of the cancellation or postponement of a game, broadcast interruption, computer virus, communications network failure, bugs, tampering, technical failure, unauthorised intervention, fraud, platform outage, or another cause beyond the Promoter’s reasonable control, the Promoter may in its sole discretion suspend, modify, postpone or cancel the Promotion and/or the Free Cheeseburger to the extent permitted by law. Any change after commencement will be made subject to applicable regulatory requirements.
18. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties, and nothing in these Conditions of Entry excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Competition and Consumer Act 2010 (Cth).
19. To the maximum extent permitted by law, the Promoter, Hungry Jack’s and their associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Promotion or claiming or redeeming the Free Cheeseburger or using the Voucher or the Hungry Jack’s App (including any reaction to a food product). This clause does not exclude liability that cannot be excluded by law or liability to the extent caused by the Promoter’s negligence or wrongful act (in each case the Promoter’s liability is limited to the minimum allowable by law).
20. Failure by the Promoter to enforce any right does not constitute a waiver of that right.
21. These Conditions of Entry are governed by the laws of New South Wales. Entrants submit to the non-exclusive jurisdiction of the courts of New South Wales.

Privacy Notice

W-Basketball Co Pty Ltd ABN 70 681 116 941 (WBCo) collects the personal information submitted through the entry form to administer the Promotion, verify eligibility, send each valid entrant the link to their Voucher and comply with applicable law.

WBCo may disclose that information to service providers involved in conducting the Promotion and to regulators where required by law. If the required information is not provided, the entrant may not be able to enter or claim a Free Cheeseburger.

To redeem a Voucher, the entrant must register for or log in to a Hungry Jack’s account through the Hungry Jack’s App. Hungry Jack’s will collect personal information directly from the entrant through the Hungry Jack’s App and will handle it in accordance with its own privacy policy at https://www.hungryjacks.com.au/privacy-policy. WBCo is not responsible for Hungry Jack’s collection, use or disclosure of that information, or for the operation of the Hungry Jack’s App.
